Disney runs the risk of going to court for selling its films on the iTunes Store. To sue the American film company, the only major Hollywood studios to have an agreement for the distribution via the Internet of most of its catalog including the most recent releases, the Starz network.
According to a press release released today and signed by the top management, the sale of some films to Apple (but also to Wal-Mart which also has an online film shop) would violate an exclusive contract. The agreement would grant Disney, and more specifically Buena Vista Television, the right to sell its films in various forms, but not to distribute them on TV or electronically, at least as long as the exclusive contract with Starz is valid.
The American TV network paid a billion dollars in 2005 for the exclusivity, asks for the immediate cessation of the distribution of films through electronic media and to have all the profits generated by Disney, Apple and Wal-Mart as a result of the marketing of the movies on the Internet.
